These Terms & Conditions ("Terms") govern your access to and use of www.vanguardjj.com (the "Site"), the services offered through it (such as free-trial bookings, contact forms, and newsletter signups), and any in-person training programs you book through the Site at our Lake Grove or Commack facilities. By using the Site or attending a class, you agree to these Terms. If you do not agree, please do not use the Site or attend our programs.
Vanguard Academy Jiu-Jitsu ("Vanguard Academy," "we," "us," or "our") operates two martial arts facilities on Long Island, NY:

You must be at least 18 years old to enter into these Terms. If you are under 18, your parent or legal guardian must agree to these Terms on your behalf and supervise your use of the Site and our services. By submitting a free-trial form or any other inquiry on behalf of a minor, you represent that you are the parent or legal guardian.
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site. Prohibited conduct includes, without limitation:
All content on the Site — including text, photography, video, graphics, logos, the "Vanguard Academy" name and marks, and the overall look and feel — is owned by Vanguard Academy Jiu-Jitsu or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may view and print pages for personal, non-commercial use. Any other use requires our prior written consent.
We may offer a free trial class to first-time visitors. The free trial is subject to the following:
Membership pricing, billing terms, cancellation policies, and class-package terms are described in your separate membership agreement signed at the time of enrollment. Those membership-specific terms govern over any general statement on the Site. We reserve the right to update pricing and program offerings at any time.
Brazilian Jiu-Jitsu, kickboxing, MMA, grappling, and related martial-arts training are physically demanding contact activities that involve inherent risks, including but not limited to bruises, sprains, strains, joint injuries, broken bones, concussions, cardiovascular events, infectious skin conditions, and in rare cases more serious injury or death.

This Section 7 is a summary; you will be asked to sign a separate, more detailed waiver and release before participating in person. The signed waiver controls in the event of any conflict.
From time to time we record photo or video at our facilities for marketing, social media, advertising, and instructional purposes. By attending a class or event, you consent to being photographed or recorded and to our use of that media in connection with promoting Vanguard Academy. If you do not wish to appear in marketing media, please notify the instructor and the front desk in writing at info@vanguardjj.com and we will accommodate reasonable requests.
By submitting a form on the Site or providing your phone number or email, you consent to receive transactional and marketing communications from us by email, phone, and SMS, including via automated technology. Message and data rates may apply. You can unsubscribe from emails using the link in any message, and you can opt out of SMS at any time by replying STOP. Opting out of marketing communications does not affect transactional messages necessary to deliver requested services.
The Site may include links to third-party websites and services (for example, our online shop, social media profiles, Google Maps, payment processors, and advertising platforms). We are not responsible for the content, policies, or practices of those third parties. Your use of those services is governed by their own terms.
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information, including in connection with advertising on Meta, Google, and other platforms.
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not guarantee that the Site will be uninterrupted, error-free, or secure, or that any defects will be corrected.
Statements on the Site about training results, fitness outcomes, weight loss, self-defense effectiveness, or competition success are not guarantees. Individual results vary based on effort, frequency of training, physical condition, and other factors.
To the maximum extent permitted by law, Vanguard Academy Jiu-Jitsu, its owners, instructors, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site, your participation in our programs, or these Terms, even if we have been advised of the possibility of such damages.
Our aggregate liability for any direct damages arising under these Terms or your use of the Site shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
You agree to defend, indemnify, and hold harmless Vanguard Academy Jiu-Jitsu and its owners, instructors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) your participation in our programs, (c) your violation of these Terms, or (d) your violation of any rights of a third party.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be highlighted on the Site. Your continued use of the Site after a change indicates acceptance of the updated Terms.
We may suspend or terminate your access to the Site or any of our services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and any membership agreement or waiver you sign, constitute the entire agreement between you and Vanguard Academy Jiu-Jitsu regarding the Site and our services.
